I Acknowledge and Accept the Safety Waiver Conditions

I understand that the risk from injury from activity carried out at Flex Fitness or any fitness club is significant, including permanent paralysis and death, and I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown. I acknowledge that this is an unsupervised fitness club and assume all risks associated with using exercise equipment in Flex Fitness without the aid and supervision of staff members on the premises.

I understand that Flex Fitness is a privately owned fitness club and HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS THE CLUB AND PROPRIETORS, and their respective owners, officers, managers and affiliates, agents and employees (”releasees”) WITH RESPECT TO ANY CLAIM OR DEMAND WHICH MAY ARISE IN RESPECT OF ANY INJURY, DISABILITY, DEATH, OR LOSS OR DAMAGE to any person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES or otherwise, that may arise out of or in connection with my use of the equipment or the facilities at the club premises or any incident that occurs while using the club’s facilities or engaging in club activities, or off the club premises or, otherwise related to my club membership.

I will keep the Releasees indemnified against all claims, actions, losses and expenses of any nature which the Releasees may suffer or incur or for which the Releasees may become liable in respect of or arising out of:

a) The neglect or careless use or misuse by myself or any guest under my control of the club facilities or equipment;
b) Any accident or damage to property or persons arising from any occurrence in or near the Club’s facilities, wholly or in part by reason of any act of omission by myself or any guest under my control.

I expressly agree that this release is intended to be as broad and inclusive as permitted by the law and if a portion of this release is held invalid, the balance shall remain in full force and effect.
I understand that the club is relying on this release in agreeing to enter into this Agreement.

In addition, I agree to the following conditions:

1. I will follow and adhere to all rules posted in the club and as instructed by club staff
2. I will use the club during staffed hours
3. I will treat the members, staff, equipment and other facilities with respect

LIABILITY WAIVER:
I accept responsibility for my use of any and all apparatus, appliance, facility, privilege or service whatsoever, owned and operated at this club at my own risk, and shall hold this club, its shareholders, directors, employers representatives and agents harmless from any and all loss, claim, injury, damage, or liability sustained or incurred by me resulting therefrom.

At Flex Fitness, we are committed to providing our members and guests with a safe and enjoyable experience. We offer sauna facilities at selected clubs as part of our dedication to promoting health and wellness. This policy outlines the rules and regulations for using the sauna at Flex Fitness.

GENERAL RULES
- The sauna is only available for use during the operating hours of the club.
- Members and guests must be at least 18 years old to use the sauna.
- Proper swimwear must be worn at all times in the sauna.
- Bring a towel to sit on at all times in the sauna.
- Food and drinks are not allowed in the sauna.
- Smoking and the use of electronic cigarettes are strictly prohibited in the sauna.
- Mobile phones and cameras are not permitted in the sauna.
- Do not use the sauna if you are under the influence of alcohol or drugs.
- Do not use the sauna if you have any open wounds or contagious skin conditions.
- Shower before and after using the sauna.
- Limit sauna sessions to a maximum of 15 minutes at a time.
- Do not use the sauna if you are pregnant or have a heart condition without consulting a doctor first.
- Do not use the sauna if you have any medical conditions that may be affected by heat.

Flex Fitness reserves the right to refuse access to the sauna to anyone who does not comply with these rules.

SAFETY PRECAUTIONS
The sauna is a high-temperature environment and can pose risks if not used properly. To ensure your safety, please follow these precautions:
- Stay hydrated by drinking plenty of water before, during, and after using the sauna.
- Do not pour water on the sauna rocks or heater.
- Do not use any oils or lotions in the sauna as they can cause the benches to become slippery.
- If you feel dizzy, lightheaded, or experience any discomfort, leave the sauna immediately.
- Remove all metal jewellery before using the sauna.
- Do not touch the sauna heater or rocks as they can cause burns.
- Do not use the sauna if you have any metal implants or devices in your body.
- Do not use the sauna if you have recently had a tattoo or piercing.
- Do not use the sauna if you have any allergies or sensitivities to heat.

COMPLIANCE & OBLIGATIONS
Flex Fitness is committed to complying with all relevant laws and regulations regarding the use of saunas. As such, we adhere to the following obligations:
- The sauna is regularly inspected and maintained to ensure it is in safe working condition.
- All sauna users must sign a waiver before using the sauna, acknowledging the risks and agreeing to follow the rules and precautions outlined in this policy.
- Flex Fitness staff are trained in sauna safety and are available to assist with any questions or concerns.
- Any accidents or injuries that occur in the sauna must be reported to a staff member immediately.
